1. General Conditions
The following conditions apply only to the orderings made through the website www.oto-fan.com.
Once your order has been validated on our website you recognize having read and accept the present general conditions with the exception of any other document having only an indicative value.
Cancelling a clause or in the case a clause of the present conditions cannot be applied do not cancel the other clauses which remain of course valid and applicable.
2. General Informations
The products we deliver are directly and exclusively from official producers and/or suppliers.
Ordering can be made through the www.oto-fan.com site 24h a day, every day of the year. The sold products are of high quality and always at our best price. The products are in line with european rules.
The terminology of the product is « diecast model cars » as far as metal is used. The product belongs to the category of toys. However those model cars do not suit for children under 14 years old. Certain models hold sharp parts and should not be given to children. The products we offer for sale are new and guaranteed against structural defects.

The informations given by the client at the time of ordering are binding. In case of error in the given delivery address oto-fan can not be hold responsible for non-delivery. Return and new delivery costs will be charged.
Orderings are completed when confirmed by the payment of the price by the buyer. Each modification or cancelling of an order that has been paid shall not be taken into consideration and the payment not refunded.
The offerings of the products are valid as long as stocks are available.
If a product is temporarily not available oto-fan will inform the buyer by e-mail within 3 days. In this case the buyer has the possibility to change his order by e-mail to oto-fan.
Oto-fan reserves the right to cancel an order from a buyer with whom there has been a litigation.
4. Delivery
Our parcels are delivered by UPS, DPD and the Post.
Shipping rates depend from the country of destination and the weight of the package.
Orders are processed and delivered from Monday till Friday from Belgium within an indicativ delivery time of 1 to 2 working days for european destinations and 3 to 5 working days for other destinations. Dated as from the reception date of the order and within the limits of our stocks.
Deliveries made by DPD take normally between 2 and 4 weekdays depending on the final destination.
Deliveries for normal sendings from the belgian Post normally take 2 to 4 weekdays depending on the destination.
In case of payment by bank transfer the delivery time starts at the date of reception of the payment on our account.
If the delivery time exceeds the mentioned indicativ time there is no recourse.
In case of force majeure or events not under the control of Oto-fan we can not be held responsible for delays or defaults in the delivery of the goods. Force majeur events are war, riots, fire, strike, accidents or the impossibility of being supplied. In due time the buyer will be informed by e-mail if one of those events should occur.
Hower we commit ourselves to deal quickly each delivery problem.
We guarantee the reimbursement of the goods as well as the transportation costs in case of damage or loss or if the goods do not fulfill the specifications of your order and after checking with the transporter and our after-sales department.
The reimbursement includes the return costs of the goods toward our offices.
If possible we will propose you a standard exchange of the goods.
The buyer has to check the goods are in accordance with the order before signing the delivery sheet. In case of a problem this should be mentioned on the delivery sheet.
Oto-fan has the right to split the delivery but without supplement for the buyer.
Remark: parcels sent by the belgian Post are not insured.
5. Modes of payment
You can make your payment with your credit card in our completely secured online payment system or through bank transfer.
Cheques are not accepted.
By credit card : we accept VISA and EUROCARD/MASTERCARD .
Before processing an order the validity of the credit card used will be verified by the completely secured OGONE e-commerce system and the amount to be paid will be reserved.

Our electronic internet payment system is completely safe and made through OGONE e-commerce (cfr www.ogone.com) a specialised internet payment company. OGONE guarantees total privacy of your credit card data by using the SSL protocol , a high standard encrypting system and dedicated firewalls. It means that even oto-fan has no access to your credit card details.
6. Invoicing
Our customs have the possibility for choosing an invoicing address different from the delivery address. This allows you to give somebody a present through oto-fan.com .
A detailed invoice, including a 21% VAT for EU delivery destinations, is made and joins every sending.
7. Prices – Transportation costs
The prices mentioned on our site use exclusively the EU currency (EUR).
All our prices are all taxes included (21% VAT) but do not comprise the transportations costs. Transportation costs (VAT included) will be shown to you at the moment of defining your order in our online system (and of course before confirmation). They vary according to the country of destination. For destinations outside the European Union you will have to apply with your customs authorities in order to get back the belgian VAT. For deliveries outside the EU the client has to check himself which import rules , taxes and duties apply locally.
Oto-fan has the right to adapt its prices at any moment. But the price paid for an order will always be the price indicated at the moment of confirmation of the order in our system.
The option « wrapping for a gift » allows you for the modest sum of EUR 0,50 to have your ordered automodel packed into nice gift paper. You can even ask us to join a little card (A8 format). If you want a personalized text can be printed on this card. You just have to introduce this text in our online system at the moment of ordering.
8. Protection of your personal data
Oto-fan guarantees the security of the content of its files.
Your e-mail address will in no way be sold or hired , nor will be any of your other personnal details we collect during your registration, an order or at the time of a poll.
Information Technology and Liberties : The Belgian Law n°78-17 article 27 from January 6, 1978 grants the right to the customer to check and rectify his personal data stocked in the files of oto-fan.
Oto-fan took the same decision concerning the CNIL (Commission Nationale de l’Informatique et des Libertés) in France.
9. Returns
In case of problems products can be returned within 14 days and after contacting by e-mail info@oto-fan.com explaining the reason of dissatisfaction.
A copy of the invoice has to be joined to the return parcel send as recorded delivery to the following address:
The customer will be refunded within 8 days and after verification of the goods.
10. Disputes
Belgian Law applies to the present general conditions.
Every complaint will be analysed seriously and we will try to find rapidly a solution.
In case of legal proceedings only the belgian courts of Nivelles will be competent.
11. Confidentiality
Oto-fan guarantees the confidentiality of the personal data of its clients. In no case those data will be transfered to third parties.
The client can be granted access to his data in our files. Those can be modified or cancelled on simple demand.
12. Transfer of ownership and risk
Transfer of ownership of the ordered goods takes place after complete payment of the ordre by the buyer. Whatever the date of delivery of the goods.
Risk transfer takes place at the moment of reception of the goods by the buyer.
If the goods can not be delivered for any reason independent of oto-fan then the risk transfer takes place at the moment where the parcel leaves our offices.
13. Guarantee of the goods
Our products our guaranteed as far as you dispose of the invoice.
We do not guarantee : defects and their consequences due to misuse of our products

16. Remarks
The texts, photographs, images and informations about the products mentioned on our website are not binding.
Oto-fan can not be held responsible about an error in the information or illustration of a product in case of changes made by the supplier or manufacturer.
If the source of the error is oto-fan itself we will exchange or reimburse within 7 days the product after return of the complete product in its original stage and comprising a copy of the invoice.
Reimbursment will be made to the person which has paid the product by bank transfer.
Incomplete , damaged or dirty products will not be taken back.
